Terms & Conditions (T&Cs)
These Terms & Conditions apply to orders placed via our online shop. They also include customer information required for online commerce, with clear sections on contract formation, delivery, payment, withdrawal rights, and warranty.

I. Terms & Conditions
 
§ 1 Scope, Definitions
(1) These Terms apply to all contracts concluded via www.moebel-lippold.com between you (the customer) and us, Möbel Lippold MC GmbH. 

(2) A “consumer” is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. 

(3) A “business customer” is a natural or legal person, or a partnership with legal capacity, acting in the exercise of their trade, business, or profession when concluding a legal transaction.
§ 2 Contract Formation
(1) The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order. 

(2) By clicking “Buy now” (or a comparable button), you submit a binding offer to enter into a purchase contract. 

(3) The contract is concluded when we accept your offer by an explicit declaration (for example a dispatch confirmation) or by dispatching the goods. An automated order confirmation email does not constitute acceptance unless it explicitly states otherwise.
(4) Order process: add items to cart, proceed to checkout, enter delivery and billing details, select payment method, review order summary, and submit the order. 

(5) For payment methods that require external processing (for example PayPal or Klarna), you may be redirected to the provider and then returned to the shop. 

(6) Manual quotation requests are possible. Written quotations are valid for 5 days unless a different validity period is stated in the quotation.
§ 3 Prices, Payment Methods, Due Date
(1) All prices include statutory VAT where applicable, unless expressly stated otherwise. 

(2) Shipping costs are charged separately and shown during checkout before you submit the order. 

(3) Available payment methods are displayed in the checkout. Payments are due immediately unless agreed otherwise. 

(4) If you select Klarna payment options, Klarna may carry out a credit assessment. The payment provider’s terms may apply in addition.
§ 4 Retention of Title
(1) The goods remain our property until full payment has been received. 

(2) For business customers, extended retention of title applies: the goods remain our property until all claims arising from the ongoing business relationship have been settled in full. Business customers may resell the goods in the ordinary course of business; resulting claims against third parties are assigned to us in advance.
§ 5 Delivery, Delivery Times, Transfer of Risk
(1) Delivery times are stated on the product page and/or during checkout. 

(2) Studio Collection (ready-to-ship items): typically 3–10 working days within Germany/EU, depending on order size and destination. 

(3) Individual Collection (made-to-order): production and delivery typically 8–14 weeks depending on specification, materials, and capacity; binding timeframes follow from the individual quotation and/or order confirmation. 

(4) For consumers, the risk of accidental loss or damage transfers only upon delivery to the consumer. For business customers, the risk generally transfers upon handover to the carrier/shipping provider, unless mandatory law provides otherwise.
§ 6 Warranty / Defects Liability
(1) For consumers, statutory warranty rights apply. For new goods, claims for defects are generally time-barred after two years from delivery. 

(2) In consumer sales, if a defect becomes apparent within 12 months from delivery, it is presumed that the defect already existed at the time of delivery, unless this presumption is incompatible with the nature of the goods or the defect. 

(3) For business customers, the limitation period for defect claims is one year from delivery to the extent legally permissible. Statutory recourse claims remain unaffected.
(4) Natural characteristics of materials (for example wood grain, knots, tonal variation, marble veining, texture differences, hand-finished individuality) are inherent product features and do not in themselves constitute a defect, provided the agreed quality is otherwise met. 

(5) Please inspect deliveries immediately for completeness and transport damage and document visible damage where possible (photos). This supports efficient handling; your statutory rights are not restricted by this request.
§ 7 Withdrawal Rights (Consumers Only), Exclusion for Made-to-Order
(1) Consumers generally have a statutory right of withdrawal. Details are set out in our Withdrawal Policy. 

(2) There is no right of withdrawal for contracts for goods that are not prefabricated and for which an individual selection or determination by the consumer is decisive, or which are clearly tailored to personal needs (made-to-order / Individual Collection).
§ 8 Liability
(1) We are liable without limitation for intent and gross negligence as well as for injury to life, body, or health. 

(2) In cases of slight negligence, liability for breach of essential contractual obligations is limited to the typical, foreseeable damage. 

(3) Otherwise, liability is excluded to the extent legally permissible. Mandatory statutory liability provisions remain unaffected.
§ 9 Governing Law, Jurisdiction, Final Provisions
(1) German law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). 

(2) If the customer is a consumer residing outside Germany, mandatory consumer protection rules of the country of residence remain unaffected. 

(3) For business customers, the place of jurisdiction is, to the extent permissible, 63303 Dreieich, Germany. 

(4) If any provision is or becomes invalid, the remaining provisions remain effective.

2) Contract Conclusion
Contract conclusion is governed by Section I § 2. Orders are confirmed by email. Acceptance takes place via dispatch confirmation or by dispatching the goods.
3) Contract Language, Storage of Contract Text
(1) Contract language is German. 

(2) You may print or save your order details before submitting the order. 

(3) We do not store the full contract text permanently online in a form accessible to customers. Essential contract information is provided to you by email.
4) Codes of Conduct / Trust Seals
Where displayed, we comply with quality criteria of external trust programs (for example Händlerbund buyer protection seal or comparable schemes). Details can be provided on request or via the respective providers.
5) Product Information
Dimensions, materials, features, finishes, and care instructions are provided in each product description. Handcrafted items may show natural, material-typical variations.
6) Prices and Payment
All prices include statutory VAT where applicable. Shipping costs are charged separately. For deliveries outside the EU, customs duties, import VAT, and clearance fees may apply and are typically payable by the recipient under the destination country’s rules.
7) Delivery Conditions
Delivery conditions, delivery times, and shipping methods are shown during checkout and in our Shipping Information page. For consumers, risk transfers only upon delivery.
8) Warranty
Warranty provisions follow Section I § 6. Statutory consumer rights remain fully unaffected.
9) Right of Withdrawal
Consumers generally have a statutory 14-day right of withdrawal unless a statutory exception applies. Made-to-order and individually configured goods produced to customer specifications (for example custom dimensions, fabric, colour, or finishing) are excluded from withdrawal. Please see our Withdrawal Policy for details.
10) Online Dispute Resolution / Consumer Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/odr  

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
